For writers, it could be a dangerous tightrope to walk when writing about other people, especially when it involves gender-based violence and other serious violent crimes.<\/strong><\/h2>\n\n\n\n<div style=\"height:52px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">According to Amber, she was writing the <a href=\"https:\/\/www.washingtonpost.com\/opinions\/ive-seen-how-institutions-protect-men-accused-of-abuse-heres-what-we-can-do\/2018\/12\/18\/71fd876a-02ed-11e9-b5df-5d3874f1ac36_story.html\">op-ed<\/a> in solidarity with other domestic violence victims, hoping to expose problems within the legal system. It now seems her words should have been chosen more carefully. A court in Virginia recently found her liable for defamation against Johnny Depp, which will cost her $8,35 million.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In her op-ed, Amber Heard made three statements:<\/p>\n\n\n\n<div style=\"height:52px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<ul class=\"wp-block-list\"><li><em>\u201cI spoke up against sexual violence \u2014 and faced our culture\u2019s wrath. That has to change.\u201d (2) \u201cThen, two years ago, I became a public figure representing domestic abuse, and I felt the full force of our culture\u2019s wrath for women who speak out.\u201d (3) \u201cI had the rare vantage point of seeing, in real time, how institutions protect men accused of abuse.\u201d\u00a0<\/em><\/li><\/ul>\n\n\n\n<div style=\"height:52px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">The sentence <em>\u201cThen two years ago, I became a public figure representing domestic abuse\u201d<\/em><em> <\/em>implied that she was writing about Johnny Depp without directly mentioning his name. Everything she wrote before and after this sentence had severe implications for his life and his career. These three statements were enough for him to take legal action against Amber Heard.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The phrasing of sentences and your choice of words can have dire repercussions for you as a writer and your credibility. Lawsuits are not only very expensive but can be a very stressful situation to find yourself in.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It is important to understand that freedom of speech does not grant writers the freedom to write anything they want without evidence of the facts as a backup.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Does this mean that you can never write anything controversial or scintillating? Of course not. But here are some guidelines you can follow to protect yourself:<\/p>\n\n\n\n<div style=\"height:52px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Be sure you fully understand defamation and the law<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.legalwise.co.za\/help-yourself\/legal-articles\/understanding-basics-defamation\">Legal Wise<\/a> defines defamation as: \u201cAn unlawful publication of a statement made by a person (\u201cdefamer\u201d) about another person (\u201cdefamed\u201d). Publication generally refers to instances where a third party hears or reads the statement. The statement may cause harm to the defamed\u2019s good name, reputation, and dignity.\u201d<\/p>\n\n\n\n<div style=\"height:52px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Only write what you can prove<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Before you write anything, ask yourself what proof you can provide in court should you be sued. Who are your sources? Are they credible? You can do this by writing in the form of opinion, \u201cthey said\u201d, \u201cI think\u201d, or \u201cshe believes\u201d.\u00a0 Make use of rhetorical questions, and avoid factual allegations, the use of \u201cseems\u201d or \u201cappears\u201d would be a much better word choice.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The biggest takeaway here is that as a writer, it is your duty to act ethically and truthfully.
